Terms of Service

These terms are an agreement between you (or the company you represent) and InnovativeLabs ("Mailboxer", "we", "us") for the use of Mailboxer, including the app at app.mailboxer.io, the API and related services. By creating an account or using Mailboxer you agree to these terms.

1. Your account

You must be at least 18 and able to enter a contract. Keep your login details safe; you're responsible for activity under your account and your workspaces, including your team members and clients.

2. Plans and billing

  • Paid plans are billed in advance, monthly or yearly, in US dollars. Add-ons such as email packs, AI credit packs and Reply Agent are billed as described when you buy them.
  • Upgrades take effect right away and are prorated. Downgrades take effect at the end of your paid term.
  • Subscriptions renew automatically until you cancel. You can cancel at any time in the app; cancellation takes effect at the end of your paid term.
  • Fees are non-refundable except where the law requires otherwise. Taxes are added where applicable.
  • Plan limits (mailboxes, emails a month, AI credits, client workspaces) are shown on the pricing page and in the app. Unused AI credits and email packs expire as stated when you buy them.
  • Spinbox mailboxes bought inside Mailboxer are billed separately from your Mailboxer plan.

3. Acceptable use and anti-spam

Mailboxer is for legitimate business outreach. You agree that you will:

  • Follow all laws that apply to your messages, including CAN-SPAM, GDPR, CASL, the TCPA and similar rules for email, text and calling.
  • Only contact people you have a lawful basis to contact, and honor every unsubscribe and opt-out promptly.
  • Use accurate sender information and subject lines, and include a working unsubscribe method and your physical business address.
  • Get any consent the law requires before sending text messages or iMessages.

You agree that you will not:

  • Send spam, phishing, malware, or deceptive, fraudulent or illegal content.
  • Use purchased or scraped lists in ways the law doesn't allow, or contact people who have opted out.
  • Send content about illegal goods, adult content, gambling, or get-rich-quick, debt and similar high-risk offers.
  • Impersonate anyone, hide your identity, or misuse mailboxes or domains you don't have the right to use.
  • Try to get around plan limits, sending limits or our abuse protections, or interfere with the service.

We may suspend or limit sending, pause campaigns or close accounts that break these rules or harm our deliverability, our customers or email recipients, with or without notice.

4. Your content

You keep ownership of the leads, messages and other content you put into Mailboxer. You give us permission to use it only to provide and protect the service. You're responsible for your content and for your right to use it.

5. AI features and Reply Agent

AI features, including Reply Agent, act on the rules, company details and instructions you give them. AI output can be wrong, so review your settings and monitor results. You're responsible for messages sent on your behalf, including messages written by Reply Agent.

6. Third-party services

Mailboxer connects to services you choose, such as email providers, calendars, CRMs, LinkedIn tools and texting providers. Your use of those services is governed by their own terms, and we aren't responsible for them.

7. API

You may use the API, including through your own AI agents, within your plan limits and these terms. Keep your API keys secret; you're responsible for all activity using them.

8. Availability and changes

We work to keep Mailboxer available and may improve or change features over time. If we make a change that materially reduces your paid plan, we'll tell you in advance.

9. Deliverability

We provide tools that help your email reach the inbox, but inbox providers make their own decisions. We don't guarantee delivery, inbox placement, replies or meetings.

10. Disclaimers and limitation of liability

Mailboxer is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, and we aren't liable for indirect, incidental, special or consequential damages, or lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Indemnity

You'll defend and indemnify us against claims arising from your content, your messages or your breach of these terms or the law.

12. Termination

You can stop using Mailboxer and cancel at any time. We may suspend or end your access if you break these terms. After your account closes you can ask us to export or delete your data, subject to legal record-keeping.

13. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

14. Changes to these terms

We may update these terms. If changes are material we'll tell you by email or in the app before they take effect. Continuing to use Mailboxer means you accept the updated terms.
